If you use the Services on behalf of an organization, you represent that you are authorized to do so. By using the Services, you agree to the practices described here. If you do not agree, you should not use the Services.
1) Who we are; roles
Controller (website & account data): Custom GPT Solutions LLC, for information we collect directly through our websites and account onboarding.
Processor/Service Provider (customer content): For prompts, files, and other content you submit into your workspace, we generally act as a processor/service provider to you, processing only as necessary to deliver the Services and as permitted by your settings and these terms.

2) Information we collect
We collect information in the following categories:
- Identifiers & contact data (e.g., name, email, phone, address, account ID).
- Commercial & transactional data (e.g., plan, purchase history, invoices, fulfillment status).
- Payment data (limited billing details; full card data is handled by Paddle as our Merchant of Record; we do not receive your full card number). For Paddle’s processing and privacy practices, see your Paddle receipt or their posted terms.
- Device & usage data (e.g., IP address, browser/OS, device IDs, referring/exit pages, timestamps, feature use, crash logs).
- Customer content you submit (e.g., prompts, files, instructions, configuration, datasets, feedback).
- Support communications (e.g., tickets, call notes, attachments).
- Cookie/SDK data (analytics, preference, and authentication cookies; see Section 10).
- Inferences we derive to improve relevance, quality, or security.
Sources include information you provide, information collected automatically during use, and information from service providers (e.g., payment, analytics, fraud prevention, identity verification) and third-party integrations you connect
3) How we use information (purposes)
We use information to:
- Provide and secure the Services (account provisioning, authentication, content processing, availability, incident response, fraud/abuse prevention).
- Operate, maintain, and improve features and performance (including debugging and quality assurance).
- Personalize your experience, including remembering settings and tailoring content within your workspace.
- Communicate with you (service messages, updates, security alerts, surveys, and—where permitted—marketing).
- Comply with law and enforce terms, including protecting our rights and users.
- Research & development: We may use de-identified or aggregated information to analyze trends and improve the Services. We do not use your Customer Content to train or fine-tune models for other customers unless you opt in (see Section 7).
4) Legal bases (EEA/UK only)
Where the GDPR/UK GDPR applies, our processing bases include: contract performance, legitimate interests (e.g., securing and improving the Services, preventing abuse, and communicating about similar products), consent (for certain marketing and cookie categories), and legal obligations. You may withdraw consent at any time where applicable
5) How we share information
We do not sell your personal information. We share information as follows:
- Vendors/Processors who provide infrastructure, hosting, security, analytics, email, payments, support tooling, and similar services under contract.
- Third-party integrations you enable (e.g., storage, identity, or workflow tools).
- Affiliates for internal business operations consistent with this Policy.
- Business transfers (e.g., merger, acquisition, financing, or sale of assets).
- Legal, safety, and rights (e.g., to comply with law, valid legal process, or to protect users, the public, or the Services).
- De-identified/aggregated data that does not identify you.
For California (CPRA) purposes, we do not sell personal information and we do not share personal information for cross-context behavioral advertising unless you consent to such cookies; you can manage these preferences as described in Section 10.

Your rights depend on your location, but may include:

7) Customer Content, model improvement, and human review
- Ownership. You retain rights in your Customer Content and resulting outputs, subject to applicable law.
- Processing. We process Customer Content to deliver and support the Services, to maintain security, and to comply with law.
- Model improvement. We do not use Customer Content or outputs to train or fine-tune models for other customers unless you opt in via settings or written agreement.
- Human review. Limited, role-based human review may occur for abuse, security investigations, or when you request support (e.g., to diagnose a defect), subject to confidentiality obligations.

8) Retention
We retain information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal obligations, to resolve disputes, and to enforce agreements. Criteria include account status, feature needs, legal limits, and the sensitivity of the data. We may retain de-identified data without time limit, and we do not attempt to re-identify it.
9) International transfers
We operate in the United States. If you access the Services from outside the U.S., your information may be transferred to and processed in the U.S. and other countries with different data protection laws. Where required, we rely on appropriate safeguards (e.g., Standard Contractual Clauses and supplementary measures) for transfers.
10) Cookies and similar technologies
We use cookies and similar technologies to enable core functionality (e.g., login), to remember preferences, and for analytics. Marketing/advertising cookies are off by default and used only with consent where required. You can: (a) manage consent in the cookie banner or settings; (b) adjust browser controls; and (c) use global privacy signals (e.g., GPC) that we endeavor to honor where feasible. 11) Security
We implement administrative, technical, and physical safeguards appropriate to the nature of the data and our role as a processor/service provider. No method of transmission or storage is completely secure; you are responsible for maintaining the confidentiality of your credentials and for using appropriate security on your systems.
12) Children’s privacy
The Services are not directed to individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us so we can take appropriate action.
13) Automated decision-making
We may use automated systems to detect abuse, spam, or fraud and to tailor certain features. We do not make decisions with legal or similarly significant effects solely using automated processing without human involvement
14) Third-party services and links
The Services may link to or interoperate with third-party websites, apps, or services. Their privacy practices are governed by their own policies, not this one. Review those policies before using third-party services.
15) Changes to this Policy
We may update this Policy to reflect changes in our practices or applicable law. Material changes will be communicated via email, in-product notice, or posting on our website. The “Last Updated” date will reflect the effective date.
